What is same sex Divorce?
Divorce refers to the legal dissolution of a marriage or civil partnership. To legally end a same sex marriage or civil partnership, it must go through dissolution (the legal term for divorce). Going through a divorce can be a particularly difficult matter, as the dissolution can either be mutual and amicable, or negative and acrimonious. Grounds for divorce are very flexible, but most commonly involve adultery, unreasonable behaviour and desertion.
Separation refers to when both parties have decided to split up but it has not been legally dissolved. If you have bee separated for two years, you can precede the divorce petition as long as both parties consent. The same is valid if you’ve been separated for five years, although no consent is need required from either party.
You should know…
A divorce is split into four stages:
1) serving the divorce petition to the other party.
2) acknowledgement of service by your spouse, or by yourself, if the petition has been served to you
3) obtaining the Decree Nisi – this is when a judge can pronounce that the grounds for your divorce are valid.
4) obtaining the decree absolute – this is the document that legally ends your marriage.
