the process of getting a family visa

Like all visa’s, you will first need to fill in a form to apply for your family visa.

Once the application is made either online, by a representative or via post, you may need to take a test to make your application eligible. For example, if you are a spouse who is applying for a visa, you will need to pass an English language test and you will have to take a medical test. Take a look at the citizen’s advice page for detailed information on visa tests.

For all family visa’s, you will also have to provide evidence and proof. This includes:

  • Your personal information ( i.e name, date of birth, evidence of identity etc.)
  • Your partner’s details
  • Proof of relationship
  • Evidence and documents for your children
You should know…

If you apply for a family visa outside of the UK, a decision is normally made within 12 weeks.

If you apply in the UK, a decision is normally made within 8 weeks if you use the standard service, or you can use the super priority service.

  • The fee for applying outside the UK ranges from £1,523 – £3,250
If you're applying inside of the uk

If you are applying from within the UK, the areas are generally the same. However, this can cover extending your stay with your family if you’re already in the UK on a family visa

You may be able to switch to a family visa to stay with your spouse, child or parent.

Why Might it be difficult for me to Obtain a Family Visa?

Applying for a family visa is always complex and individual to your personal case. You may have problems if:

  1. You’re unsure whether you meet the requirements

-It’s not often clear to see if you qualify for a family visa or not.

  1. You want to challenge the decision (or rejection) of your application

– A consultation will tell you any problems that are in your application. However, if your application has been rejected for an unfair or odd reason, a legal representative will be able to challenge this and help you complete your application.

  1. English is not your first language, and you need a lawyer to complete your forms for you

-The application is complex enough without the difficulty of it being in a different language. A lawyer will be able to provide you with a step by step run-through of the application to ensure you have a clear path to completion.

  1. You have a criminal record or a poor immigration history

-If your previous application was rejected, or if you have a history of criminal behaviour, you may need an immigration lawyer to represent you.

5. Your case is particularly complex

-If your visa route has a high refusal rate or your application particularly complex, you may need a lawyer to help you with your complex case and to represent you.

how can a lawyer help you to obtain a family visa?

Applying for a family visa, in particular, a spouse visa can be complicated because it requires a large amount of evidence and support. Supporting evidence can include proof of address, identity documents and proof of finances. Obtaining a family visa can also be an expensive process. The financial requirements for spouse visa applications is a minimum of £18,600, which is the minimum gross annual income threshold. This will be even higher if you are applying with children.

Because of the sheer amount of evidence needed for a spouse or family visa, it can be the most complex immigration application to prepare adequately. A lawyer will be able to help you with all of your documentation, from collecting and checking, to reviewing the application and evidence before the application is submitted.

A lawyer will also be able to help you if your case is especially complex. For example, if you have already been deported, if you have a criminal record or if you have an application that has been previously denied.
