wHAT IS CHILD LAW?
Child law mainly deals with what happens to children following a divorce or dispute between parents. However, it can also cover when children are in situations of danger or abuse. It is the sum of all law that regulates or handles a child’s life situation, including the child’s rights.
For same-sex parents, caring for children can be especially difficult, especially if the parents are going through a difficult situation themselves. When going through a divorce or dispute it can be hard to look through emotions and balance everything that’s going on.
You should know…
1. Child law research also covers child psychology. Studies of child law can also show parents how to talk to their children, the impact of welfare interventions on a child’s mental state and how the parents actions can affect a child’s development.
2. Legally, any person under the age of 18 is classified as a child So protecting a child’s welfare and rights until they reach adulthood is an essential requirement for parents.
Common Areas of Child Law
Child Arrangements and Child Custody
Child arrangement orders are used to determine who has custody of a child in the event of a divorce or separation. They are used to decide where a child lives, when and for how long a child sees each parent, and how often they have contact in general with each parent.
Child arrangement orders are normally only used when parents cannot informally come to an agreement over their child. They are not mandatory, however many people choose to have them drawn up as a precautionary measure.
Child Maintenance
While child maintenance determines how much a parent needs to contribute to the other for the care of their children, this is treated separately from the overall divorce financial settlement, which deals with any marital assets.
Specific Issue and Prohibited Steps Orders
Specific issue orders are used to rule on certain aspects of a child’s life that may not have been considered during the divorce process. One such example would be a child’s religion, whether they are raised religiously, or in a secular environment.
Prohibited steps orders are designed to prevent a parent from taking a certain action that will impact a child’s life. For example, a prohibited steps order might say that a child must remain in private education until they are 18, or other such issues.
How Can a Lawyer Help with Child Law?
Many couples who go through divorce will successfully agree upon child arrangements upon mediation or informally, between them. However, where a marriage or civil partnership has broken down completely, it can be difficult to come to an informal agreement.
It’s in these situations that it’s useful to have a child law lawyer on your side to explain what you can reasonably expect to achieve throughout the child arrangement procedures.
Your lawyer should complete the relevant court order applications for you, and chase the court to ensure they have received your papers and that they are reviewing them.
Then, if a hearing is necessary, your lawyer can represent you in court to ensure your best chances of success.
